Speeding: a top cause of trucking accidents, P.2

In our previous post, we began looking at the topic of speeding in automobile accidents, particularly in truck accidents. As we noted, research has shown that speeding is a top cause of truck accidents. In addition to the “critical events” which speeding can cause on the roadway, research has categorized various underlying causes for truck accidents involving speeding.

These include things like: the driver fell asleep, had a heart attack or was physically impaired; the driver was distracted or failed to take notice of the situation; the driver made errors in judgment; and the driver panicked, overcompensated, or exercised poor directional control. Various factors can play into an accident occurring, such as traffic congestion, prescription drug use, fatigue, brake problems, and so on. 

All of this is to say that speeding accidents can involve a variety of conditions, causes and factors. Some of these secondary considerations are within a trucker’s control and some are not, at least not fully.

In an effort to address the problem of speeding among commercial truckers, Senator Charles Schumer recommended earlier this month that commercial trucking companies should be required to install speed-capping devices in all vehicles within their fleets. Schumer is recommending that truckers be limited to 65 miles per hour. The National Highway Traffic Safety Administration and the Federal Motor Carrier Administration made this recommendation back in August, citing concerning crash statistics.Time will tell how far the recommendation makes it in the rule-making process, but the trucking industry is bound to heartily object, as it typically does when lawmakers are regulators seek stricter safety rules.

Those who are involved in truck accidents should, of course, always work with an experienced attorney to ensure they have zealous advocacy seeking the compensation they deserve. This is especially important in cases where the accident occurred because of speeding or some other preventable behavior.
