Last time, we briefly considered the potential usefulness of claiming hostile working environment for undermining an employer’s justification of adverse employment action based on alleged poor performance, as well as some of the characteristics of hostile work environment.

What is a hostile work environment?

In our last post, we said that it is often difficult for employees to prove that an employer had a discriminatory motive in taking adverse employment action against them, where in refusing to hire, refusing to promote, demoting, terminating, or any other aspect of employment. Lack of direct statements indicating a discriminatory motive and the employer’s own attempt to pass off the employment action as justified by the employee’s performance can be big hurdles to overcome in discrimination litigation.

Previously, we looked at the ongoing litigation against CNN regarding allegations of racial discrimination. As we noted last time, Fox News has been dealing with its own discrimination litigation filed by former employees, including Gretchen Carlson of Fox & Friends and former analyst and commentator Andrea Tantaros.

Nowadays, news organizations are under a good deal of scrutiny over bias and inaccuracy in reporting, but this is not the only issue major news outlets are facing. Workplace discrimination is another issue plaguing some companies, including CNN.
